Police interrupted a 79-year-old man receiving oral sex from a homeless woman in a South West car park, a court heard. Brendan McPhillips was arrested in the multi-storey in Lower Union Lane, Torquay.

The pensioner appeared at Newton Abbot Magistrates’ Court in Devon on Wednesday to face the single charge of outraging public decency by behaving in an indecent manner. He pleaded guilty.

The court was told the incident happened on the afternoon of May 29 last year. An aggravating factor in the case is that it was half-term week and the car park was in use by members of the public including children.

CCTV footage captured the defendant urinating before receiving oral sex. McPhillips, of Princes Road West, suggested to police he was drunk at the time.

The pensioner was represented in court by solicitor Mr Alan Parsons. Mr Parsons said it was the second case of its kind this week.

He said there were no sentencing guidelines for the offence and recommended the case be adjourned for a pre-sentence report. Magistrates agreed.

They told McPhillips his case would be adjourned until April 24. In the meantime he would have to speak to a probation officer who would compile a report with a view to a suitable sentence.
